Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of products, services, and platforms provided by Fashionaholic, L.L.C., dba Janet Mandell ("Janet Mandell," "Company," "we," "us," or "our"), including rental and purchase of apparel and accessories ("Products") through our retail locations, mobile stylists, or digital channels. By accessing, renting, purchasing, or using any Products or Services, you agree to be bound by these Terms.

Eligibility & Account

You must be at least 18 years of age to enter into a rental or purchase agreement. Products may be worn by minors, but the contract must be executed by an adult. You agree to provide accurate, current, and complete information for billing, delivery, and account purposes. A valid government-issued ID and credit card must remain on file for the duration of any rental period.

Rental vs. Purchase

Rentals are not purchases. Ownership of Products remains with Janet Mandell at all times. Deposits may be required for one-of-a-kind, vintage, or high-value items. All rentals are final sale; no refunds will be issued.

Fees, Payments & Authorizations

By placing an order, you authorize us to charge your provided payment method for rental fees, security deposits, delivery charges, dry cleaning fees, late fees, alteration charges, loss, theft, or damage costs. Fees exclude applicable taxes, customs duties, levies, or surcharges, which you are responsible for. We may pre-authorize or charge deposits up to 50% of retail value for top-tier Products. If payment is declined, we reserve the right to cancel orders and suspend services.

Delivery & Return

Delivery is available at an additional cost and may be performed by a stylist or courier. A Secure Shipping Address (where someone can physically accept delivery) is strongly recommended. Products must be returned by the specified due date using the provided packaging. If packaging is lost, you must return Products at your expense, with tracking provided. Late returns incur a daily late fee equivalent to one (1) rental period, and if not returned within 20 days, the Product will be deemed a non-return.

Product Care, Loss & Damage

You agree to treat Products with care and return them in good condition, accounting for normal wear and tear. You are responsible for theft, loss, destruction, major stains, alterations, or permanent damage. Unauthorized alterations (e.g., cutting dress length) incur charges up to 3x retail value for rare or vintage pieces. If damages exceed normal wear, you may be charged up to 200% of the Retail Value.

Additional Obligations

All garment bags, hangers, shoe bags, and jewelry boxes must be returned, or a $25 fee per item will apply. Dry cleaning fees apply to all worn clothing items. Stylist fees are non-refundable ($50 Chicago, $75 Los Angeles and New York).

Intellectual Property & Media Release

By engaging in our Services, you grant us permission to use your image, voice, likeness, and name in connection with social media and marketing, unless expressly revoked in writing.

Limited Warranty & Disclaimers

Products are provided "AS IS", and we disclaim any warranties of merchantability, fitness for purpose, or non-infringement. Our liability is limited to replacement or pro-rated refund of rental fees, at our discretion.

Limitation of Liability

We are not liable for indirect, incidental, punitive, or consequential damages, including loss of profits or opportunity. Our maximum liability is limited to the rental fees paid for the affected Product or Service.

Termination & Collections

We may terminate your right to rent or purchase Products at any time. If unpaid balances occur, you are responsible for collection costs, including attorneys' fees.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in courts located in Cook County, Illinois, or the U.S. District Court for the Northern District of Illinois.

Miscellaneous

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Janet Mandell. If any provision is found unenforceable, the remainder remains in effect. We are not responsible for performance failures due to events beyond our reasonable control, including natural disasters, war, or government actions. We reserve the right to modify these Terms at any time. Updates become effective immediately upon posting or notice.

Final Provisions

All rentals are final sale. No refunds. Items are not held without full payment. Authorization of credit card use covers any additional charges incurred during or after the rental period.
